Terms and Conditions, including Terms of Delivery

1. Definitions

  • Client: Any person purchasing a book, e-book, or lifestyle program for personal use.

  • Participant: Any individual enrolled in the Plants for Health lifestyle program for personal use.

  • Plants for Health Program: The complete lifestyle program with all included components.

  • Cooking Workshop: Live cooking event at a specified location.

  • Plants for Health Coach: Qualified healthcare professional authorized to offer the program and lead individual or group sessions.

  • Individual Consultations: One-on-one sessions between participant and Plants for Health Coach, in-person or online.

  • Group Sessions: Gatherings with multiple participants and one or more coaches.

  • Book: Plants for Health book.

  • LMS: Online Learning Management System for program participants.

  • Forum: Group discussion platform integrated into the LMS.

  • Meet-ups: Online live group events for large audiences.

2. Duration and Termination

  • Program duration is specified on the website and starts after full payment.

  • Instalment payments are possible; failure to pay may result in suspension from the program and its services (including LMS, forum, group sessions).

  • Plants for Health reserves the right to exclude participants if deemed necessary, for example, for medical reasons, referring the participant to a suitable care provider.

3. Prices, Payment, and VAT

  • Dutch Webshop:

    • Prices are in euros (€) and include Dutch VAT (BTW) at the applicable rate.

    • Payment can only be made in euros (€); other currencies are not supported.

  • International (English) Webshop:

    • Prices are shown exclusive of VAT (Value Added Tax) and can be paid in various currencies, depending on the customer’s location and payment options.

    • The final price may be subject to applicable taxes, duties, and currency conversion fees determined by local authorities or payment providers.

    • Customers are responsible for any additional charges required by their country.

  • Payment for all products and services must be completed before delivery or program access.

  • Instalment plans (if applicable) are processed via automatic debit.

  • In case of late payment or non-payment, Plants for Health may charge administration and collection costs, and access may be suspended until obligations are fulfilled.

4. Delivery and Access

  • Printed books are shipped within 2–5 business days of payment; delivery times depend on location and carrier. Plants for Health is not liable for shipping delays or errors by carriers.

  • Loss or damage during shipment must be reported within 14 days of the estimated delivery date.

  • Digital products (e-books, online programs) are available for immediate download or access after successful payment.

  • Access to the online program is provided via a unique login sent to the participant’s registered email.

  • Participants and clients must ensure their contact details are accurate.

  • All products and content are for personal use only and may not be shared or distributed without explicit written approval.

5. Services and Responsibilities

  • Plants for Health will provide all services as detailed on the website.

  • In case of illness or unavailability of a coach, suitable replacement will be provided.

  • Coaching, workshops, and group sessions may have additional behavioral or participation guidelines, communicated in advance.

6. Changes and Cancellations

  • Individual consultations may be rescheduled free of charge up to 48 hours prior to the scheduled appointment.

  • Group sessions and cooking workshops can be rescheduled free of charge up to one month before the event.

  • Cancellations outside these periods are not eligible for a refund.

7. Privacy and Confidentiality

  • Plants for Health adheres to strict professional confidentiality standards; all personal information is handled confidentially and not shared with third parties without explicit consent, except where required by law.

  • Plants for Health complies with the General Data Protection Regulation (GDPR).

  • Participants have rights to view, correct, or request deletion of their data; requests should be made to info@plants-for-health.nl.

  • Details regarding personal data handling are described in our Privacy Policy on our website.

8. Intellectual Property

  • All intellectual property rights related to Plants for Health products and services remain exclusively with Plants for Health.

  • Clients and participants may use products and services for personal, non-commercial purposes only, unless otherwise agreed in writing.

9. Website and Platform Use

  • The website and LMS may only be used for personal, non-commercial purposes.

  • Unauthorized copying, distribution, or use of content is prohibited without written consent.

10. Health Disclaimer

  • All information and content is intended for educational purposes, not as a replacement for professional medical advice, diagnosis, or treatment.

  • In case of medical conditions, health concerns, or doubts, clients and participants must consult their physician or qualified health provider before starting.

  • Participation and usage is at your own risk. Plants for Health is not liable for any injury or loss except in cases of intent or gross negligence.

11. Liability

  • Plants for Health is not liable for direct, indirect, or consequential damages resulting from program participation or content use, except in cases of intent or gross negligence.

  • Clients and participants assume full personal responsibility for their decisions and actions.

12. Force Majeure

  • Plants for Health is not liable for delays or non-delivery arising from events beyond its reasonable control, including but not limited to natural disasters, pandemics, strikes, ICT failures, or governmental actions.

13. Warranty and Refunds

  • Product specifications are detailed on the website.

  • Full information on shipment and returns is set out in the Shipping and Returns Policy.

  • Complaints will be assessed, and refunds issued if applicable, after product return and review. Shipping costs are non-refundable.

14. Transfer of Rights

  • Rights and obligations under these terms may not be transferred without the written consent of Plants for Health.

15. Changes to Terms

  • Plants for Health reserves the right to modify these terms at any time. Changes will apply to new agreements after publication. Participants will be notified via the website or email.

16. Complaints Procedure

  • Complaints can be submitted via info@plants-for-health.nl. Plants for Health aims to respond within 14 business days.

  • Unresolved disputes may be submitted to independent arbitration or the competent court.

17. Governing Law and Jurisdiction

  • These terms are governed by Dutch law.

  • Disputes are exclusively subject to the jurisdiction of the court in Utrecht, the Netherlands.
